Modernising Divorce Laws
That this Assembly acknowledges that divorce can be a difficult process for any individual or family to go through; recognises that the current process can exacerbate conflict and have a profoundly negative impact on the well-being of children; notes that existing law pertaining to divorce under the Matrimonial Causes (Northern Ireland) Order 1978 is outdated, does not allow a choice for no-fault or fault-based divorce, and therefore requires reform; further notes the need to reduce the separation period required for no-fault divorce and establish a single generic fault, so that in cases of irreconcilable relationship breakdown, couples can avail of divorce without having to further prolong conflict and disagreement; further acknowledges the Minister of Finance’s commitment to introduce a bill to modernise outdated divorce laws during this Assembly mandate; and supports the introduction of legislation to provide a more amicable process for separation which can reduce conflict and the negative consequences of prolonged divorce proceedings for all parties and particularly for women and children.
