Text
I reiterate that there are two concerns about Gerry's proposals. The first is about national security determinations, which are a matter for the UK Government and do not fall within our purview, as they are reserved matters. Paragraph(2)(c) of amendment No 38 falls outside our legislative competence. That is the first thing. The Member is correct that his other amendments are within the legislative competence of the Assembly, but we argue that they would be better addressed through updates to PACE code D, which would then be subject to public consultation. That revised code will be introduced alongside the new retention framework. There is not blanket opposition to the intent, but we cannot legislate on reserved matters, and there are better ways of dealing with the amendments that are not to do with reserved matters. We are therefore not in complete disagreement.
