Text

Yes. The survey findings reflect the common sense of the vast majority of the people of Northern Ireland. In particular, two thirds of parents who were surveyed indicated that the use of toilets should be determined by biological sex. Regulation 10(2) of the School Premises (Standards) Regulations (Northern Ireland) 1973 states:

"For all pupils above the age of 6 separate sanitary fittings shall be provided for boys and girls."

The survey findings reinforce the point that there is wider public support for the policy statement that I issued on 8 September, particularly on the use of toilets and changing facilities. I was confident that the overwhelming majority of the people of Northern Ireland supported my common-sense position when it comes to biological sex. The survey findings affirm that I am right and that other Members in the Chamber are completely wrong and out of touch.

Assessment

Flagged Gender, sexuality, abortion and related social issues

Flagged on a second assessment, because Jev’s answers did not settle it. The reasons are given below.

  • Overall probability that the activity is being used to promote, exploit or escalate an identity-based controversy: 0.74 (flagging needs at least 0.70; at or below 0.30 is not flagged).
  • Criteria met: Identity framing (0.66); Dog-whistle messaging (0.67); Controversy escalation (0.61).
  • The text adopts the identity-based framing in its own voice (0.58).
  • Subject area: Gender, sexuality, abortion and related social issues.
  • The answers did not meet either automatic threshold.

Second assessment

Jev’s answers did not settle this record, so a second model, claude-opus-5-5, read the same text (without the MLA’s name or party) and gave its reasons on 21 October 2026. How the second assessment works

Against the published rubric

The contribution concerns transgender pupils' use of school toilets and changing facilities, a recognised flashpoint. It cites a 1973 school premises regulation, but most of it uses a survey to claim that "the vast majority of the people of Northern Ireland" share a "common-sense position" on biological sex and that other Members are "completely wrong and out of touch". This sets a claimed majority against a small minority and declares victory over opponents, which matches the rubric's populism and escalation markers rather than a practical account of how the policy affects pupils or schools.

Public interest or divisiveness

There is some substance: a minister is defending a policy statement and pointing to an existing legal requirement for separate facilities. However, the evident function of the answer is to claim a popular mandate on a contested identity issue and score a point against other Members, with no attention to how the policy works in practice or how affected pupils will be accommodated. Its overall effect is to deepen the argument rather than inform it.
