Text

I am absolutely delighted to welcome the decision by my colleague Paul Givan, the Education Minister, to withdraw the transgender guidance that was issued to schools in Northern Ireland. It is a significant and commendable step that reflects a commitment to clarity, fairness and the recognition of biological reality in our education system. It is also common sense. I asked for that guidance to be reviewed when I was Education Minister, then at the start of this mandate and again when Dr Cass issued her interim report, so I am pleased that we are now seeing its withdrawal. The withdrawing of the guidance ensures that schools are not compelled to adopt policies that conflict with biological facts. Importantly, the decision provides reassurance that single-sex spaces, including school sports facilities, changing rooms and toilets, can remain protected, where appropriate, in accordance with safeguarding considerations and biological sex. That is particularly fundamental for the safety and privacy of young girls. Furthermore, teachers and pupils will not be placed under pressure to use language, such as pronouns, that denies biological fact. That upholds the rights to freedom of belief and expression for all members of the school community and avoids compelling speech that may conflict with personal convictions or scientific understanding. The Minister's decision follows careful consideration of the judgement issued in For Women Scotland Ltd v The Scottish Ministers and the important legal implications that that case holds for departmental policy. It is right that educational guidance in Northern Ireland align with legal precedent and provide schools with a clear and lawful framework to support all pupils while respecting the rights of every individual. Any future guidance must be developed with due regard for biological reality, legal obligations and the welfare of all children. It is a common-sense decision that lets kids be kids.

Assessment

Flagged Gender, sexuality, abortion and related social issues

Flagged on a second assessment, because Jev’s answers did not settle it. The reasons are given below.

  • Overall probability that the activity is being used to promote, exploit or escalate an identity-based controversy: 0.46 (flagging needs at least 0.70; at or below 0.30 is not flagged).
  • Criteria met: Dog-whistle messaging (0.71).
  • Assessed as legitimate policy scrutiny (0.76).
  • The text adopts the identity-based framing in its own voice (0.59).
  • Subject area: Gender, sexuality, abortion and related social issues.
  • The answers did not meet either automatic threshold.

What a flag means. A flag means the activity contains at least one instance of culture-war framing that met the published test. It does not mean the whole activity is divisive, or that its substantive arguments are wrong.

Second assessment

Jev’s answers did not settle this record, so a second model, claude-opus-5-5, read the same text (without the MLA’s name or party) and gave its reasons on 21 October 2026. How the second assessment works

Against the published rubric

The statement welcomes the withdrawal of guidance for transgender pupils, a recognised flashpoint, and frames it around "biological reality", pronouns that "deny biological fact" and protecting "the safety and privacy of young girls". That framing implies that recognising trans pupils is a threat to girls and an imposition on others. It cites the For Women Scotland judgment and the Cass report, but does not engage with what the guidance actually said or with the needs of trans pupils. Its main thrust is welcoming the removal of a group's recognition in schools, closing with the slogan "lets kids be kids", which meets the rubric's markers for identity framing and coded language.

Public interest or divisiveness

There is some substance in the references to case law and a "clear and lawful framework" for schools. However, the statement's evident function is to celebrate a party colleague's decision and to put on record an objection to the inclusion of transgender pupils. It presents their recognition as a safeguarding risk and as compelled speech, rather than examining practical effects on all pupils. Overall it advances one side of an identity row rather than the substance of school policy.
