Text

With your permission, Mr Speaker, I will answer questions 4 and 7 together. My Department is analysing the Supreme Court judgement and considering the potential implications of the ruling for policy responsibilities that rest with the Department. Officials have also sought legal advice on the issue. Departmental officials will continue to work closely with Sport NI as it considers the impacts of the issue on the sports sector. It is my view, and, therefore, the view of the Department, that only biological women should participate in women's sports.

Assessment

Not flagged

Not flagged on a second assessment, because Jev’s answers did not settle it. The reasons are given below.

  • Overall probability that the activity is being used to promote, exploit or escalate an identity-based controversy: 0.40 (flagging needs at least 0.70; at or below 0.30 is not flagged).
  • None of the five culture-war criteria was met (each was below 0.60).
  • The text adopts the identity-based framing in its own voice (0.56).
  • Subject area: Gender, sexuality, abortion and related social issues.
  • The answers did not meet either automatic threshold.

This is an AI-generated assessment of the text, made against published criteria. It is not a finding of fact about the MLA or their intentions. The Assembly record itself is the fact.

Second assessment

Jev’s answers did not settle this record, so a second model, claude-opus-5-5, read the same text (without the MLA’s name or party) and gave its reasons on 21 October 2026. How the second assessment works

Against the published rubric

This is a minister's answer to questions on female sport. Most of it describes practical steps: the department is "analysing the Supreme Court judgement", has "sought legal advice" and is working with Sport NI on the implications for the sports sector. The closing line, that "only biological women should participate in women's sports", takes a clear side on a recognised flashpoint, and does so before the legal advice is complete. Even so, it is stated as a position on eligibility policy, with no loaded labels, no portrayal of trans people as a threat and no ridicule, so it does not meet the rubric's tests for hostility, dog-whistling or grievance.

Public interest or divisiveness

The answer mainly responds to Members' questions about how a court ruling affects departmental policy and sports bodies, which is ordinary ministerial accountability on a live legal and policy question. Its final sentence states a contested view that many will disagree with, and stating it ahead of the legal analysis gives it a declaratory quality. However, setting out a policy stance on who may compete in a category is substantive government business rather than identity point-scoring.
