Text

Generally, tenancy agreements cannot be signed by an individual who is deemed to lack capacity. However, there is potential for consideration to be given, through the Office of Care and Protection, to someone being authorised to sign a tenancy agreement on behalf of the individual who lacks capacity. That needs to be determined on a case-by-case basis. If the Member would like to write to me directly on that, I would be happy to chase it up.

This is an AI-generated assessment of the text, made against published criteria. It is not a finding of fact about the MLA or their intentions. The Assembly record itself is the fact.
