Text
A range of new enforcement powers became available to councils on 2 January 2023 under the Waste and Contaminated Land (Amendment) Act 2011. Those powers relate to articles in the Waste and Contaminated Land (Northern Ireland) Order 1997, including article 4 concerning a prohibition on unauthorised or harmful deposit, treatment or disposal of waste; article 5 regarding a duty of care as respects waste; and article 28 on powers to require the removal of waste unlawfully deposited. Under article 28 of the Waste and Contaminated Land Order 1997, a council may direct those responsible for the deposited waste to remove it. If they fail to do so, the council may intervene and remove the waste and seek cost recovery from those responsible. Under articles 4 and 5, councils may prosecute those involved in fly-tipping activity.
