Text
To ask the Minister for Infrastructure, pursuant to AQW 52264/22–27, to detail (i) whether all bidders passed the pass fail criteria, in relation to TUPE liability and signed the contractor indemnification risk to NI Water; (ii) whether the successful contractor’s offer, accepted by NI Water on 27 May 2025, was dependent on the arrangement subsequently approved by the NI Water Board on 24 June 2025, in respect of contractor liabilities under TUPE; (iii) when the potential overall cost of the successful contractor’s offer, including the new arrangement in respect of contractor liabilities under TUPE, was re-evaluated, in terms of being the most economical, advantageous tender; (iv) whether all other bidders were informed of the arrangement; (v) whether equivalent financial arrangements were made available to all other bidders; and (vi) any reasons why the arrangement, in respect of contractor liabilities under TUPE, would not be described as subsidising the successful contractor.
