Text
Again, the Member is wrong because, in that circumstance, the behaviour would not amount to therapy. Setting that aside, the staff member in question would be making a determination about implementing policy and accessing single-sex spaces on the basis of the person's sex and not their gender. That is not conversion therapy on the grounds of that individual's gender identity. The rights and wrongs of that are a matter for debate, but it would not be under the auspices of this Bill. We have taken advice that this does not intersect with the Supreme Court judgement on the definition of "sex" as per the Equality Act, which is why we have not used "sex" in the Bill. We do not want to interfere with those judgements.
