It is an excellent point, and I was going to turn to it. The drafter chose the word "opinion", which is an expressly subjective term. It is "the opinion of the Department". It is not like other legislation that talks about whether something is reasonable or whether there are reasonable grounds to believe or suspect. It is simply an "opinion". It is being hung on the hook of a personal, subjective view.
