Text

There is a real danger that the young person could be penalised by being over-charged. Many cases are borderline between assault occasioning actual bodily harm and grievous bodily harm or between grievous bodily harm and attempted murder. The PPS may run with the higher charge, so there is no accountability. An issue that is linked to that is that the alternative verdict to a murder charge is often manslaughter. How would that work in this case? Would the verdict of manslaughter not be available to the young person? That is disadvantageous to the defendant.
