Text
I appreciate the Member's giving way. First, the point has been made that it was partly to do with being able to get sufficient political consensus to make progress on the issue. Secondly, we have talked all along about there being a balance between wanting to protect younger children who may be drawn into offending behaviour and the rights of victims. When it comes to the most serious offences, the balance may fall in a different place. The list is a recognition of that simple fact. That is not to say that the things that fall immediately below it are trivial, or that the things on the list are the only serious crimes, but those are particularly heinous offences and are recognised as such even in sentencing. For that reason, there was logic in saying that those should be carved out. They are at the more extreme end of sentencing; for an adult, for example, they could carry a life sentence.
