Text
There will be two restrictions on what can happen. The first is that, in the case of anyone who has retired in the previous year, it will be for the Chief Constable to decide whether the threshold has been met; that mirrors the regulations in England and Wales. The second condition in England and Wales is that someone can be recalled only where the Independent Office for Police Conduct (IOPC) agrees that that is appropriate. We do not have that facility, which is why the ombudsman would have to agree that. A series of conditions and tests would need to be met in the ombudsman's consideration of whether anything beyond a year may be considered. That would require the ombudsman to prove, first, that it would be proportionate, fair and reasonable to reopen the issue. The second test is about whether there would be an impact on public confidence, and the third is about the seriousness of the allegation in question. The allegation would have to be of sufficient seriousness that, had it been brought up when the person was in service, they would have faced dismissal.
