  1. Debate contribution: Criminal Bar Association: Withdrawal of Services

    • Oral Answers to Questions
    • As a minister

When I made my statement last week, I set out the engagement that I had had. I had written to members of the criminal Bar individually to apprise them, first, of the action that I had taken in respect of the request that had been made of me around what we refer to as the "16% uplift" in fees — actually, in some cases,…

    • Oral Answers to Questions
    • As a minister

At the moment, we spend around £44 a head on criminal legal aid in Northern Ireland. The equivalent in England, Scotland and Wales is around £22 a head. There are reasons why that may be the case in the Northern Ireland context, however there are significant differences. One of my concerns in enabling access to…

  3. Debate contribution: Criminal Bar Association: Withdrawal of Services

    • Oral Answers to Questions
    • As a minister

I thank the Member for his question, and I think that that is a key issue. We know that there are high levels of attrition in the criminal Bar, particularly with newly qualified barristers, and that it is very difficult for people to get, if you like, a foot on the ladder and to gain experience. There are competing…

  4. Debate contribution: Criminal Bar Association: Withdrawal of Services

    • Oral Answers to Questions
    • As a minister

I note that, every time that the Member asks a question, he tries in some way to impugn my character or my integrity as part of his questioning. It can never simply be that there is a disagreement and that I am trying to resolve that disagreement. He always has to have a dig at me personally when he asks his question.…

With your permission, Mr Speaker, I wish to address questions 2, 8 and 12 together, as they speak to the same issue. As I previously advised the House, engagement to resolve the CBA's concerns has been ongoing since before the outset of its action in November 2024. I remain committed to continuing constructive…

  6. Debate contribution: Prisoners: Temporary Release

    • Oral Answers to Questions
    • As a minister

That is a very important point. There will always be those who will fail pre-release testing, but they are not the majority of prisoners who go through the system, most of whom take the opportunity for rehabilitation seriously and actually want to change their conduct and behaviour. It is the role of the Prison…

  7. Debate contribution: Prisoners: Temporary Release

    • Oral Answers to Questions
    • As a minister

When the Parole Commissioners make recommendations on an individual prisoner, the Prison Service will fully risk assess that person and begin work to prepare them for release and reintegration into society. The risk-assessment tool used is primarily the assessment case management and evaluation (ACE) system, which…

    • Oral Answers to Questions
    • As a minister

The Life Sentences Order refers to permanent release back into the community at the end of a sentence. Therefore, no one is permanently released from prison until they have served their tariff or their sentence, depending on the nature of the sentence. However, rule 27 provides the Prison Service with the opportunity…

  9. Debate contribution: Prisoners: Temporary Release

    • Oral Answers to Questions
    • As a minister

As the Member will know, a life sentence in Northern Ireland means a life sentence. However, that sentence does not have to be served solely in custody. Any life sentence prisoner who is released when their tariff has been served, and that tariff is set by a member of the independent judiciary, can be recalled to…

  10. Debate contribution: Prisoners: Temporary Release

    • Oral Answers to Questions
    • As a minister

The Northern Ireland Prison Service (NIPS) does not comment on individual prisoners or their management. NIPS does not operate a Christmas home leave scheme, as is the case in some other jurisdictions. However, eligible prisoners who are already engaged in pre-release testing may be approved for temporary release as…

  12. Debate contribution: Criminal Bar Association: Withdrawal of Services

    • Ministerial Statements
    • As a minister

First, I have not done more than an hour, because you only get an hour for a statement, so that is incorrect. Secondly, I am not litigating anything. I am doing my duty to keep Members of the Chamber apprised of important issues affecting my Department. That is my duty. Had I not come today, somebody would no doubt…

  13. Debate contribution: Criminal Bar Association: Withdrawal of Services

    • Ministerial Statements
    • As a minister

I set out a few reasons why mediation is not the answer. First, the action was announced within four days of the criminal Bar agreeing the road map and that the working group would continue to take the issues forward. There is no consistency. You cannot negotiate with people who move from here to there and from there…

  14. Debate contribution: Criminal Bar Association: Withdrawal of Services

    • Ministerial Statements
    • As a minister

With your permission, Mr Deputy Speaker, I wish to make a statement on the Criminal Bar Association (CBA) service withdrawal. It is with profound disappointment that I make the statement. It is not one that I had anticipated making in the week in which legal aid fees have been increased by 16%, in the week in which an…

  15. Debate contribution: Police Ombudsman for Northern Ireland: Resignation

    • Question for Urgent Oral Answer
    • As a minister

That is exactly what I said; that is correct. It was not pertinent to the question that I was asked in June and was therefore not included in my briefing pack, to the best of my recollection. However, I was briefed about it in an early-day briefing at the beginning of February.

  16. Debate contribution: Police Ombudsman for Northern Ireland: Resignation

    • Question for Urgent Oral Answer
    • As a minister

I am not, within my Department, empowered to make judgements about the ombudsman's office. The Public Prosecution Service made a decision not to prosecute the ombudsman. We must respect that decision. It is not for me to judge the fitness for office of the ombudsman. That is the role of the Executive Office. I suggest…

Those details were not pertinent to the question for urgent oral answer and were, therefore, not included in the briefing papers that were provided to me in June 2024.

  18. Debate contribution: Police Ombudsman for Northern Ireland: Resignation

    • Question for Urgent Oral Answer
    • As a minister

Had I been in office in 2023, I would have had no vires to accept the resignation of the ombudsman. My Department and its Minister and permanent secretary have no vires to accept the resignation of the ombudsman. The ombudsman must resign directly by notice in writing to His Majesty.

  19. Debate contribution: Police Ombudsman for Northern Ireland: Resignation

    • Question for Urgent Oral Answer
    • As a minister

Security clearance and other HR matters pertaining to the ombudsman are for the Executive Office. Security clearance is not granted by the Department of Justice. It is actually granted by the Home Office.

    • Question for Urgent Oral Answer
    • As a minister

Thank you. With respect to the publication that the Member has sought, I have said already that these matters remain sub judice. Therefore, I will not commit to the House to releasing all the correspondence and papers until I have had the opportunity to seek detailed legal advice.

  21. Debate contribution: Police Ombudsman for Northern Ireland: Resignation

    • Question for Urgent Oral Answer
    • As a minister

Let me correct a few of Mr Gaston's remarks. First, I am not a caretaker Minister. I was a caretaker Minister between the collapse of the Executive and October 2022, when Ministers were suspended. To clarify: that is the context in which the term "caretaker Minister" was used. I was not the Minister at the point at…

  22. Debate contribution: Police Ombudsman for Northern Ireland: Resignation

    • Question for Urgent Oral Answer
    • As a minister

I did not mislead the House at any time. The suggestion that I did so is very serious. Whether the House or individual Members had confidence in the ombudsman was a different matter. I did not mislead the House on those issues.
